WARRANTY AND COMPLIANCE

1.     The warranty on the Products is limited to any factory warranty that Zibro has provided with the respective Products. The foregoing applies without prejudice to the mandatory legal rights and claims that Consumers may assert against Shops4u in the context of a consumer purchase (compliance).

2.     In case of invoking any factory warranty, settlement will be made in accordance with the applicable factory warranty conditions of the manufacturer. Any costs charged by the manufacturer or supplier of Shops4u in connection with a claim under the factory warranty shall be borne by the Counterparty.

3.     A claim for non-compliance lapses in any case if a defect of the Product is the result of an external cause after delivery or another circumstance not attributable to Shops4u. This includes, but is not limited to, defects caused by external damage, natural wear, incorrect or careless handling or cleaning, and making changes to the Products, including repairs or other types of restoration not carried out with prior written consent from Shops4u.

4.     For a valid claim of non-compliance, the Consumer must timely complain to Shops4u in accordance with the provisions of article 7.3. In case of a valid claim of non-compliance, Shops4u will ensure repair or replacement of the Products within a reasonable period.

5.     If an unordered Product has been delivered, the Customer must, without prejudice to the provisions of article 4, provide the order number and the Customer’s name and address details by e-mail (info@zibroonline.com). Without prejudice to the provisions of article 4, a replacement Product will only be delivered if the wrongly delivered Product has been returned to Shops4u. The costs of return shipment shall be borne by Shops4u, unless the incorrect delivery is not due to its fault.
